TERMS AND CONDITIONS FOR JOB APPLICANTS

(hereinafter referred to as the “Terms and Conditions” or “Agreement”)

issued by GoodCall s.r.o., ID No.: 02765861, with its registered office at Křižíkova 148/34, Karlín, 186 00 Prague 8, registered in the Commercial Register at the Municipal Court in Prague, file number C 223501, represented by Mgr. Milan Novák, managing director (hereinafter referred to as “GoodCall” or “we”)

1 INTRODUCTORY PROVISIONS

1.1 Parties to the Agreement. These Terms and Conditions are a contract between us as GoodCall and the Applicant who has chosen to apply for employment through GoodCall (hereinafter referred to as the “Applicant” or “you”).

1.2 Moment of conclusion of the Agreement. The Agreement is concluded at the moment of sending the form or request of the Applicant, if the Terms and Conditions are referred to. Without agreeing to the Terms and Conditions, it is not possible to properly use our Services.

2 SERVICE

2.1 GoodCall Services. As part of its activities, GoodCall provides the following services to the Applicants:

2.1.1 Job Position. If the Applicant applies for a specific job position, we will arrange it on the basis of a concluded Agreement in accordance with these Terms and Conditions.

2.1.2 Watchdog. When using this Service, the Applicant concludes an Agreement with us by agreeing to these Terms and Conditions, on the basis of which we will send him regular job offers for the entire duration of this Agreement.

(hereinafter collectively referred to as the “Services”)

2.2 Offers of other job positions from other employers. If you conclude an Agreement with us as amended by these Terms and Conditions for the Job Positions Service (Article 2.1.1.), you are entitled to choose the option that you want to receive job offers from other employers, including us as GoodCall (similarly to the Watchdog Service). By checking the appropriate button in the form or otherwise agreeing to a specific form of offer, you are concluding an Agreement with us pursuant to this article, on the basis of which we will send you job offers according to your specialization and from other employers.

2.3 Sending offers. We send you offers in accordance with Articles 2.1 and/or 2.2. of these Terms and Conditions. We personalize job offers according to the data you have entered, only offers based on your preferences will be sent to you. GoodCall is not obliged to verify the data if it is not real, and GoodCall is not responsible for sending inappropriate job offers.

2.4 Free of charge Services. All Services provided to Applicants are free of charge.

2.5 Use of artificial intelligence. We may use artificial intelligence to provide the Services, but not for automated decision-making or profiling. More information on this is provided in the Privacy Policy.

2.6 Accuracy of data. You are responsible to us for the accuracy of the data provided in connection with the performance of the Agreement. If any of them change, you can notify us so that we can update them. This is especially important for us to send suitable job offers.

3 PROCESSING OF PERSONAL DATA

3.1 Processing of personal data. We process all your personal data in accordance with legal regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR). All information regarding the processing of personal data can be found in our Privacy Policy.

4 DURATION OF THE TERMS AND CONDITIONS AND THEIR TERMINATION

4.1 Duration of Terms and Conditions. These Terms and Conditions are concluded for an indefinite period.

4.2 Termination of Terms and Conditions. You may terminate these Terms and Conditions at any time without notice. You may terminate by sending an email to info@goodcall.eu or send your notice to our address Křižíkova 148/34, Karlín, 186 00 Prague 8.

4.3 Termination of sending job offers. If you use the Watchdog Service or have concluded a contract with us pursuant to Article 2.2 of these Terms and Conditions, we will terminate the sending of job offers on the date of termination of the Agreement as amended by these Terms and Conditions.

4.4 Complaints. We provide out-of-court settlements of consumer complaints through email info@goodcall.eu.

4.5 Out-of-court dispute resolution. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, Company ID: 000 20 869, internet address: https://coi.gov.cz/en/information-about-adr, is responsible for the out-of-court resolution of consumer disputes against entrepreneurs. The European Consumer Centre Czech Republic is also located at this address, internet address: https://evropskyspotrebitel.gov.cz/en, which is the point of contact for consumers in the EU.

5 FINAL PROVISIONS

5.1 Prohibition of misuse of GoodCall Services. You undertake not to misuse the GoodCall Services or use them for any purpose other than their intended purpose (i.e. in particular searching for or monitoring job positions). If misuse occurs, we are entitled to recover any resulting property damage and non-pecuniary damage.

5.2 Liability for outage of GoodCall Services. We are not liable for any outage of GoodCall Services if it is due to force majeure, a technical error or other unforeseeable event that affects our provision of the Services.

5.3 Governing law and jurisdiction. The legal relationship between us will be governed by the law of the Czech Republic. This also applies in the event of the existence of a so-called international element, when the norms of private international law and relevant international conventions are excluded. However, we are aware that the customer-consumer cannot be deprived of the protection provided to him by this choice by the provisions of the law of the country where he has his habitual residence. The court with subject-matter and territorial jurisdiction for these Terms and Conditions will be the court with subject-matter jurisdiction for Prague. This does not affect the rights of consumers under special legal regulations.

5.4 Date of effect of Terms and Conditions. These Terms and Conditions are valid and effective from June 1, 2025
